Verbal agreement with contractor

When two or more parties come to an agreement without any written documentation, they create a verbal agreement (known formally as an oral contract). The authority of these verbal agreements, however, can be a bit of a gray area for those who aren’t familiar with contract law. Most verbal contracts are legally binding. Verbal agreements are contracts even though they were not memorialized in a writing. Assuming that the contract is valid, the verbal agreement between two parties is binding. However, verbal contracts may have unique complications to them. Generally, verbal contracts are enforceable, but they are difficult to enforce because the only evidence is your word against someone else's. Verbal contracts may not be enforceable for specific things, such as repayment of money over a certain dollar amount.

Is a Verbal Contract Enforceable? The basic rule is that a verbal contract is just as enforceable as a written one, depending upon a few provios (which I will get to in a moment.) To create a contract, verbal or written, you need three things: 1. An offer: An offer has to be clear and unambiguous to create the basis of an enforceable contract A verbal contract can be anything that involves words or is verbalized. Verbalized can be through speech or writing. Contract types include: Service contracts such as agency agreements or car washes. The sale of goods that are not part of the Uniform C Code (UCC). Lawsuit settlements. Landlord-tenant leases. Agreements that may be performed within a year. In addition to these four elements, a binding agreement must have a lawful purpose and clear terms. So, the contract cannot provide money for someone to do something illegal or have ambiguous or incomplete terms. When Are Verbal Agreements Not Binding? Certain types of contracts must be in writing under Texas law. These include agreements for the sale or transfer of land or real estate, leases, and commissions for oil and gas drilling.
